Terms of Service & Liability Shield
Complete legal terms governing your use of UPSC AI software engines, study materials, evaluations, and prepaid passes
1. Acceptance of Terms & Legal Framework
These Terms of Service ("Terms", "Agreement") constitute a legally binding electronic agreement under the Information Technology Act, 2000, the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Consumer Protection (E-Commerce) Rules, 2020 of India, between UPSC AI (upsc.ai, "we", "us", "our", or "Platform") and you ("User", "Aspirant", "Student", or "Subscriber").
By accessing, browsing, registering for, or purchasing any access pass on upsc.ai or its associated applications, you explicitly acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms in their entirety, you must immediately terminate access to the platform.
2. Absolute Disclaimer of Exam Selection, Marks & Career Liability
UPSC AI is solely an independent educational study aid and self-practice platform. We make NO representations, warranties, promises, or guarantees regarding your performance in the Civil Services Examination (CSE) or any state PSC exam.
- No Selection Guarantee: Using UPSC AI does not guarantee selection, qualifying marks, Prelims cut-off clearance, Mains marks, or an Interview call in any examination. Selection depends entirely on candidate dedication, preparation, examination hall performance, and official commission evaluation.
- Diagnostic Scoring Nature: All AI evaluation scores (out of 10/15 marks), answer critiques, question difficulty ratings, and predicted All-India ranks are probabilistic diagnostic benchmarks generated by computer algorithms for self-study purposes. They do NOT reflect, predict, or guarantee marks from official human UPSC examiners.
- Zero Liability for Exam Outcomes: Under no circumstances shall UPSC AI, its founder (Mukesh Kumar), directors, affiliates, or technical partners be liable for exam failure, non-selection, rank discrepancies, lost attempts, emotional distress, or career outcomes resulting directly or indirectly from platform usage.
3. Mandatory Non-Affiliation & Government Disclaimer
UPSC AI is a private, independent educational technology platform. It is NOT affiliated with, authorized by, endorsed by, sponsored by, or in any way officially connected to the Union Public Service Commission (UPSC), the Department of Personnel and Training (DoPT), or any Ministry of the Government of India or State Public Service Commissions.
The acronym "UPSC" is used strictly as a nominative fair-use descriptor to denote examination syllabus alignment. All official notifications, examination dates, syllabi, admit cards, and results must be verified directly at the official government portal (upsc.gov.in).

UPSC AI delivers an integrated suite of eight technological study modules:

5. Single-User Personal License & Anti-Account Pooling
Every registered UPSC AI account is licensed strictly for individual, personal use by a single candidate:
- Zero Credential Sharing: Sharing, renting, selling, or pooling login credentials across study groups, coaching batches, or Telegram/WhatsApp channels is strictly prohibited.
- Automated Concurrent Login Detection: Our security infrastructure actively monitors concurrent multi-IP access. Simultaneous logins from disparate geographical regions will result in automated session revocation, immediate account suspension, and forfeiture of prepaid fees.
- Account Security: You are solely responsible for all actions conducted under your registered account and OTP tokens.
6. Subscription Plans, Prepaid Passes, Quotas & Refund Terms
UPSC AI operates on a transparent, prepaid access model with zero hidden auto-renewals:
The first three (3) topics of every subject across all syllabus courses are free forever for all registered users. Access to Topic #4 and subsequent topics requires an active prepaid pass.
Basic and Pro passes grant expanded feature quotas for AI chats, Mains answer evaluations, visual mindmaps, and full syllabus access. All passes are prepaid for the selected duration with no automatic recurring charges.
Feature quotas reset monthly based on plan activation. If an AI request fails due to server timeout or network error, our system automatically executes a compensating transaction to refund the consumed credit back to your account balance.
If you are not satisfied with UPSC AI, you may request a 100% full refund within seven (7) calendar days of purchasing your initial paid pass by emailing support@upsc.ai. Full terms are specified in our Refund Policy.
7. Intellectual Property & Printable PDF License
All platform interfaces, proprietary algorithms, database schemas, question explanations, answer evaluation rubrics, mindmaps, and visual posters are the exclusive intellectual property of UPSC AI:
- Personal Study License: Pro plan subscribers receive a personal, non-exclusive, non-transferable, revocable license to download and print visual PDF resources solely for private study.
- Prohibited Piracy: Uploading, reselling, republishing, or redistributing UPSC AI study materials, PDF wall charts, or question sets on third-party websites, Telegram channels, or commercial forums is strictly illegal and subject to criminal prosecution under the Copyright Act, 1957.
8. Prohibited Activities & Platform Abuse
You agree not to engage in any of the following prohibited activities:
- Reverse engineering, decompiling, or attempting to extract proprietary code, AI prompt matrices, or scoring rubrics.
- Deploying automated scrapers, web crawlers, bot scripts, or launching DDoS attacks against our servers.
- Attempting prompt-injection attacks, jailbreaks, or generating defamatory, abusive, or unlawful content.
- Uploading malicious files, viruses, or infringing third-party intellectual property.
9. Multi-Cloud Architecture, Foundation AI Providers & Upstream Service Disruption Immunity
UPSC AI utilizes an enterprise multi-cloud and multi-model infrastructure to maintain high availability and evaluate thousands of concurrent student queries and Mains copies. You expressly acknowledge and agree that:
Our backend clusters and databases operate across Amazon Web Services (AWS), Microsoft Azure, Oracle Cloud Infrastructure (OCI), Google Cloud Platform (GCP), and Supabase, managed through dynamic multi-provider routing layers, intelligent load-balancing gateways, and edge CDN networks.
Platform query synthesis and handwriting evaluation leverage enterprise APIs from leading AI research laboratories, including Google DeepMind (Gemini), OpenAI (GPT Models), Anthropic (Claude), Mistral AI, and specialized deep learning OCR pipelines.
While our multi-router systems execute automated failovers during provider degradation, UPSC AI shall NOT be held liable for temporary downtime, latency surges, API rate limits, model hallucinations, or response delays caused directly or indirectly by upstream cloud outages, datacenter fires, fiber cuts, or service suspensions originating from AWS, Microsoft Azure, Oracle Cloud, Google Cloud, OpenAI, Anthropic, or telecom SMS gateways.
UPSC AI bears zero liability for failures or delays resulting from government-mandated regional internet shutdowns (common during state examinations), severe network congestion, banking gateway failures (UPI/NPCI/Razorpay), or unforeseen cyberattacks (Force Majeure).
10. Limitation of Liability & Comprehensive Indemnification
Comprehensive Indemnification: You agree to defend, indemnify, and hold harmless UPSC AI, its founder (Mukesh Kumar), directors, employees, affiliates, and technical partners against any and all claims, liabilities, lawsuits, damages, losses, penalties, and legal fees arising from: (a) your use or misuse of the platform; (b) any handwritten answers or content uploaded by you; or (c) your breach of these Terms.
Liability Monetary Cap: To the maximum extent permitted by applicable Indian law, in no event shall UPSC AI's aggregate liability for all claims arising out of or relating to these Terms exceed the total subscription fee actually paid by the user in the three (3) months immediately preceding the event giving rise to liability, or ₹500 INR, whichever is less.
Exclusion of Consequential Damages: In no event shall UPSC AI be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, career opportunities, time, emotional distress, or exam attempts.
11. Governing Law, Individual Arbitration & Class Action Waiver
These Terms shall be governed by and construed in accordance with the substantive laws of the Republic of India.
- Arbitration: Any dispute or claim arising out of or in connection with these Terms shall be resolved by binding arbitration under the Arbitration and Conciliation Act, 1996 by a sole arbitrator appointed mutually. The seat of arbitration shall be in India.
- Class Action Waiver: You expressly agree that all disputes must be brought in an individual capacity and not as a plaintiff or class member in any class, collective, or representative proceeding.
- Jurisdiction: Subject to arbitration, the competent courts in India shall have exclusive jurisdiction.
